Use of Contract Builder and Attached Contracts Policy

Because each country has different laws regarding how our community can borrow/lend properties, specific terms of service may be provided for the country in which the property is located.

Overview

NomadRooms.com offers a service called “Contract Builder.” This service helps room owners, known as Partners, communicate to room borrowers, known as Nomads, extra terms and conditions for using their property.

How does it work?

During property registration, Partners can elect to add additional terms to their listing by using NomadRoom’s Exclusive Contract Builder section. This function allows Partners to add up to ten (10) additional terms at no additional costs to the Partner/s listing. Once completed, the contract is review by NomadRooms specialists and approved.

Members may notice extra terms required when making a booking. This is the contract made by the Partner when the listing was created. Members must check each term on the contract to show they have read the term and they agree to the term, and they agree to any penalties related to the term.

When a Partner creates a contract, the contract must be approved by NomadRooms specialists before the listing can be booked. Usually, the listing and the contract are created at the same time and approved for publishing at the same time. When a booking is made the contract is “frozen” for that booking. That means if the contract is changed after a booking is made, the version of the contract valid during the time of the booking remains valid for the booking; in effect, it becomes part of the booking. And remains available for future referencing.

ALL TERMS CREATED BY THE CONTRACT BUILDER OR ANY OTHER ATTACHED CONTRACT ARE MEANT TO BE A RECORD OF AGREEMENT AND NOT A LEGALLY BINDING CONTRACT.

What if?

  1. What if a member violates a term on the Contract Builder?
    Included with the contract builder is the ability to assign penalty rates – an amount due if the term is violated. If a term is violated and NomadRooms.com staff agree that it was violated, the penalty fee may be withdrawn from the security deposit and paid to the Partner.
  2. What if a member violates a term on the Contract Builder and refuses to pay the penalty?
    First NomadRooms specialists will determine the extent of the damage caused to the property. The following steps taken will depend largely on the amount of damage caused.
  3. What if my contract was not approved?
    When your contract is denied, you will get an email detailing why it was denied. The email may make suggestions on how you can improve the contract, but will not mention exact wording to use as NomadRooms does not provide legal advice. At that time you can make the necessary changes and reapply to have it approved.
  4. What if the a Partner changes the contract on a listing that is already live? 
    Once a contract for a listing is modified in any way, it is automatically submitted to NomadRooms specialists for review and the listing is placed in a “pending” state. The listing can still be viewed by Members who have already used it for a booking or past booking, but is not available for future bookings until the new version of the contract is approved. The time to approve a change is usually very fast, less than 24 hours.
